My approach as a mediator

In employment disputes, parties are often emotionally and commercially at odds. As a business mediator, I bring structure to that process. I help employer and employee bring the real interests to the surface and reach a solution together, without it escalating into a UWV procedure or a lawsuit.

Whether it concerns a disrupted employment relationship, a dismissal issue or a conflict over employment terms: in many cases, mediation offers a faster, cheaper and less burdensome route than litigation.

Employment disputes: mediation as an alternative to court

Employment law regulates the rights and obligations of employers and employees. For entrepreneurs, this is one of the most sensitive areas of law: a conflict with an employee can lead to prolonged absence, productivity loss and reputational damage. Mediation offers a way to resolve this conflict without it escalating into a costly procedure.

As a business mediator, I guide employers, managers and employees through employment disputes towards workable agreements, quickly and confidentially.

What is employment law?

Employment law regulates the relationship between employer and employee. Think of:

  • concluding and terminating employment contracts;
  • pay, working conditions and secondary employment terms;
  • summary dismissal or dismissal via UWV and the subdistrict court;
  • non-compete and non-solicitation clauses;
  • reintegration during illness and conflicts about absence.

Employment law revolves around the question: what are the rights and obligations of employer and employee, and how do you resolve a conflict about them?

Why mediation in employment disputes?

Employment disputes are burdensome for all parties. Legal proceedings often lead to:

prolonged sickness absence or suspension
disrupted relationships in the workplace
reputational damage for both employer and employee
high legal costs and uncertain outcomes

Mediation helps you as an entrepreneur to:

gain clarity quickly and de-escalate the situation
reach a solution without a costly lawsuit
restore the employment relationship or end it with dignity

Common employment disputes where mediation helps

Employment disputes take many forms. For each of the situations below, mediation offers an effective way out:

1. Dismissal conflicts

Conflicts around summary dismissal, reorganisation or a disrupted employment relationship. Mediation can lead to an amicable termination through a settlement agreement.

2. Workplace conflicts

Tensions between colleagues, between employee and manager, or within teams. Mediation helps parties move forward together again or achieve a workable separation.

3. Sickness & reintegration conflicts

When employer and employee disagree about recovery, the reintegration plan or suitable work, mediation can break an impasse without the UWV or the court having to get involved.

4. Disputes over employment terms

Disputes over pay, bonuses, role changes or working conditions. Mediation offers a neutral space to reach an agreement.

How does a mediation process work in an employment dispute?

A mediation process for an employment dispute generally goes through the following steps:

1. Introductory meeting

Exploration of the conflict, the positions and the interests of all parties involved.

2. Joint sessions

Employer and employee discuss the situation in a structured, neutral environment.

3. Searching for solutions

The focus shifts from positions to interests: what does each party really want to achieve?

4. Recording agreements

Agreements reached are laid down in a settlement agreement or mediation accord, legally binding.

Mediation versus legal proceedings in employment disputes

Faster

Weeks instead of months or years. Parties set the pace themselves.

Cheaper

No prolonged UWV or court procedure. The costs are considerably lower.

Confidential

No public proceedings. What is discussed stays confidential.

Advantage: Mediation does not preclude legal proceedings. It gives parties the chance to work things out together and on their own terms before it gets to that point.

Employment mediation in connection with other disputes

A mediator who brings calm to a hopeless situation

"After months of stalled negotiations with my co-shareholder, I had little hope left. Richard managed to normalise relations and restart the conversation within just a few sessions. What struck me: he truly listens, asks the right questions and forces you to think about what you actually want. No judgment, no taking sides — just a clear and structured process. We ultimately reached a workable buyout arrangement without going to court. Enormous relief."
